Welcome to the digital services offered by Ryzer Recruit, LLC ("Ryzer Recruit", “Recruit”, "we", "us" or "our"). Ryzer Recruit is a web and mobile system that provides prospective student athletes the ability to showcase their validated physical and mindset achievements and attributes to college, national/Olympic, and/or professional team coaches as well as the general public.
This Privacy Policy (“Policy”) applies when you use our Services. We offer you choices about the data we collect, use and share as described in this Policy. Ryzer Recruit is committed to protecting your privacy through our compliance with this Policy. This Policy should be read in conjunction with our Terms of Service, into which this Policy is incorporated by reference..
This Policy tells you how we will use the information entrusted to us when you visit or use https://ryzerrecruit.com (“Website”) or any other online site, mobile application, service, or product that links to this Privacy Policy (collectively the "Services"). Unless otherwise stated in a separate agreement between you and Ryzer Recruit that governs your use of Ryzer Recruit's web and/or mobile based application software, this Policy also applies to the content that users store on our system, including any personal information.
Ryzer Recruit works closely with two other independent Ryzer companies: Ryzer, LLC (“Ryzer”) and Ryzer Mindset, LLC (“Ryzer Mindset”). Ryzer builds technologies and services that enable athletes and event attendees to connect with coaches and event organizers. Your use of Ryzer’s Services is governed by Ryzer’s Terms of Service and Privacy Policy. When applicable, this Policy may be superseded by specific terms in the aforementioned Terms of Service and Privacy Policy between Ryzer and its users. Ryzer Mindset offers an end-to-end online system for helping athletes and teams succeed mentally at every level. Your use of Ryzer Mindset’s Services is governed by Ryzer Mindset’s Terms of Service and Privacy Policy. When applicable, this Policy may be superseded by specific terms in the aforementioned Terms of Service and Privacy Policy between Ryzer Mindset and its users.
This Policy applies to information we collect on this Website and the Services or in emails and other electronic messages between you and this Website or the Services. This Policy applies to your use as a Visitor of the Website and as a user of the Services as either a Ryzer Member or Ryzer Coach (as defined in our Terms of Service).
This Policy does not apply to information collected by us offline or through any other means, or information collected by Ryzer, Ryzer Mindset, or any third party through any application or content (including advertising) that may link to or be accessible from the Services.
We are continually improving our websites and other digital properties by adding new features and products. Because of these enhancements and changes in the law, we may modify this Privacy Policy. If we make material changes to it, we will provide at least 15 days' notice through our Services, or by other means such as email, to provide you the opportunity to review the changes before they become effective. Modifications to this Privacy Policy will be posted at the top of this page designated by the "Last Updated" and "Effective Date of Last Update". If you object to any changes, you may cease using the Services and/or close your account by emailing us at privacy@ryzer.com.
We collect or receive the following general types of information when you use the Services: personal identifiers (such as contact information, cookies, etc.), information protected against security breaches (such as your name, username and password), protected classification information (such as gender), commercial information (such as a credit card number), Internet/electronic activity, professional or employment related information (such as role, TAP assessment results), education information (such as school attending), and inferences from the foregoing. More specifically, we collect the following information from various sources:
You may provide information directly to us through the Services in several different ways. For example, you may input information for display in your online resume, respond to specific questions or surveys, communicate with us via email or feedback forms, complete online registration forms, and subscribe to email newsletters or other similar communications. The types of information you may provide directly include the following, as applicable:
Name;
City and/or state or residence;
Email address;
Telephone number;
Birthdate/age;
Gender;
Videos;
Athletic information (e.g., sport and position);
School;
High school graduation year;
Photograph;
Academic information (e.g., transcripts, test scores);
Information relating to your team(s);
Information relating to your coach(es);
Information relating to your parent(s) or guardian(s);
Other relevant information.
We collect certain information about you and your computer automatically when you use the Services. Automatically collected information may include:
The type of web browser and operating system you have used to access the Services
Your IP address (which is a number automatically assigned to your computer when you access the Internet and can be used to derive your general geographic location)
Your device information (which may include information about the mobile device you use to access our mobile application, including the hardware model, operating system and version, unique device identifiers, and mobile network information)
The website you visited before you came to the Services and
Information about the content and web pages you view, clickstream patterns, dates and times that the Services are accessed, and the features you access on the Services that we collect using cookies, Web beacons, and similar technologies.
We also have commercial data-sharing agreements with third-party companies, including Ryzer and Ryzer Mindset (“Recruit Data Sources”), that allow their users to share data with us. Depending upon your user settings and the respective privacy policies of the Recruit Data Sources, information and data about you, including personal information, could automatically be shared with Recruit. Automatically collected information from Recruit Data Sources may include:
Your biographical/personal information and/or Troutwine Athletic Profile (TAP) assessment results (e.g., athletic mindset data) and/or other pertinent information derived and delivered from Ryzer Mindset;
Your biographical/personal information, physical attributes, athletic testing results, and/or other pertinent information delivered from Ryzer and derived from your Ryzer account and/or participation in a Ryzer event;
Your biographical/personal information, physical attributes, athletic testing results, and/or other pertinent information derived and delivered to us from a third party company.
We may receive additional information about you from Ryzer Data Sources and potentially other sources, such as third-party companies we work with, data cooperatives and public databases.
We may receive information about you from other individuals (e.g., from your parent or representative that inputs information about you on your online Recruiting Resume). We may combine all of the information we collect or receive about you and use or disclose it in the manner described in this Policy.
We may use information about you for various purposes related to performing our Services, including:
Provide, maintain, and improve our Services, including to process information, develop new applications and services, and manage the performance of our platform and Services;
Display information about you (e.g. your matched TAP athlete type or list of Ryzer events you have participated in), which will be visible on your Recruiting Resume;
To perform analytics to continually improve the Services and enhance your experience with the Services;
To manage your account, perform billing and payment activities;
Detect, investigate, and prevent fraudulent transactions, abuse, and other illegal activities; to protect the rights, property, or safety of Ryzer Recruit and others; to enforce compliance with our policies including our Terms of Service; and to comply with applicable law and government requests;
Perform accounting and administrative tasks, and enforce or manage legal claims; and
For any other purpose disclosed to you at the time we collect your information, or pursuant to your consent.
We may use information about you for various purposes related to communicating with you, including:
To update you on your status (including confirmation of content updates or notices of leaderboard appearances);
To respond to your requests, questions, and comments;
Communicate with you in accordance with your account settings, about products, services, and events offered by us and others, to provide news and information that we think will be of interest to you, or to conduct online surveys;
Send you technical notices, updates, security alerts and support, and administrative messages.
We may use information about you for various other purposes, including to:
Provide you (and enable our partners to provide you) with promotional materials, relevant content and advertisements, surveys, newsletters, questionnaires, and other materials that match account holder profiles or interests;
Facilitate contests and other promotions; and
Combine with information that we collect for the purposes described in this Policy.
We may engage third-party companies or individuals as service providers to help support our business. Information about the subprocessors we use to support our Services can be found in our Subprocessor Policy. Similarly, we may establish system integrations with third-party partners offering complimentary services to ours in order to allow you to share your Personal Data across multiple systems (such as recruiting, compliance, or evaluation services). These third parties have limited access to your Personal Data to perform these tasks on our behalf, your behalf, or on behalf of our corporate affiliates (including Ryzer and Ryzer Mindset) and are obligated to us not to disclose or use it for other purposes.
Business Transfers and Affiliates - As our business evolves, we (or our owner Ryzer, LLC) may buy or sell businesses or other assets. In the event of a corporate sale, merger, dissolution, bankruptcy, reorganization, or similar event, your Personal Data may be part of the transferred assets. You acknowledge and agree that any successor to or acquirer of Ryzer Recruit or its assets will have the right to continue to use the Personal Data and other information you provide to us in the manner set out in this Privacy Policy. We may also disclose your Personal Data to our corporate affiliates (including Ryzer and Ryzer Mindset) in order to help provide, understand, and improve our Services and our affiliates' services. If we do so, our corporate affiliates and subsidiaries use and disclosure of your Personal Data will be subject to this Privacy Policy.
Third-Party Connections (e.g. Facebook) - In some instances, you can connect your account to third-party services. If you connect your account with a third-party service, we may collect, store, use, disclose, and/or transfer your Personal Data with such third-party services in accordance with this Privacy Policy. For example, if you connect your Ryzer account with Facebook, we request permission from Facebook to access and store your email address, Facebook ID, and similar information needed to provide you with our Services. We have no control over how a third-party connection uses or discloses the Personal Data you provide to them, or that we provide to them with your consent by connecting your accounts. Consult the third-party's information collection and protection policies prior to using the third-party.
Aggregate and Anonymized Information - We may share aggregate and anonymized information with third parties for marketing, advertising, research or similar purposes.
Our legal basis for collecting and using the information described above will depend on the type of information and the specific context in which we collect it. For example:
We process information about you in order to provide our Services in accordance with our Terms of Service, for example to develop your Recruiting Resume, or to display your Recruiting Resume to other users, and to allow us to send you important service updates;
We also process information about you where it is in our legitimate interests to do so and not overridden by your rights (for example, in some cases for direct marketing, fraud prevention, network and information systems security, responding to your communications, the operation of team and organization accounts, and improving our Services);
In some cases, we may also have a legal obligation to collect information about you, or may otherwise need the information to protect your vital interests or those of another person; and
We may also process information to comply with a legal requirement or to perform a contract.
We may share your information in the following manners:
If you are a Ryzer Member, we may share portions or all of the information categories listed below with other users of our Services including Visitors, Ryzer Coaches, and other Ryzer Members:
Personal Data
Information that can be associated with or which relates to a person and/or could be used to identify a person, e.g., Name, Birthdate, Photograph, etc.
Biographical Data
Information that provides details about a person but cannot be used to identify a person, e.g., School attended, Sport played, etc.
Mindset Data
Information on a person’s mindset characteristics and strengths, e.g., matched athletic mindset archetype, TAP traits, etc.
Athletic Data
Information on the physical attributes and athletic testing results on a person, e.g., Height, 40-yard dash time, etc.
If you would not like to share the above information
(i) do not submit the information into your Recruiting Resume in the first place (e.g. your photograph);
(ii) revisit your settings with Ryzer here: https://ryzer.com/ManageAccount/ or Ryzer Mindset here: https://mindset.ryzer.com/tap-myaccount.php or for other third party Recruit Data Providers, visit their respective privacy policies and sharing settings on your account with them;
(iii) delete your Ryzer account by sending an email to us at privacy@ryzer.com.
If you wish to make a personal information request related to the retention, use, or access of your Personal Data, you may contact us at privacy@ryzer.com and we will consider your request in accordance with applicable laws and respond within 45 days of receiving a personal information request. Such requests must include a copy of your driver's license or other government issued form of identification to confirm your identity. Personal information requests are limited to two per 12-month period.
You may also share your information via third-party online social networks. By sharing your information from our Services with any social media service, you are authorizing us to share information we collect from and about you with the social media service provider, other users, and your network of contacts on the social media service, and you understand that the social media service's use of the shared information will be governed by the social media service's privacy policy. If you do not want your personal information shared in this way, please do not share your information with a social media service provider.
We also may share your information with entities that provide services to us, including companies that provide payment processing, shipping, web analytics, data processing, web hosting, technical support, advertising, email distribution, and other services.
There may be instances when we disclose your information to other parties in order to:
protect the legal rights of Ryzer Recruit, its affiliates, and of the users of the Services;
protect the safety and security of users of the Services;
prevent fraud (or for risk management purposes); or
comply with or respond to the law or legal process or a request for cooperation by a government entity, whether or not legally required.
We may also share your information with third parties in aggregated or non-personally identifiable form.
3.6 Other Parties in Connection With a Transfer of Assets
If we make a sale or transfer of assets, or are otherwise involved in a merger, divestiture, acquisition, liquidation, or transfer, or in the unlikely event of bankruptcy, we may transfer your information to one or more third parties as part of that transaction.
In addition to the sharing described in this Policy, we may share information about you with other third parties when you consent to such sharing.
If you do not want your information shared with any third party who may use such information for direct marketing purposes, then you may opt out of such disclosures by updating your account preferences accordingly or sending an email to us at privacy@ryzer.com.
Your information may be disclosed and otherwise transferred to an acquirer, successor or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which your information is transferred to one or more third parties as one of our business assets and only if the recipient of your Information commits to a Policy that has terms substantially consistent with this Policy.
Your information may be physically or electronically transferred to an acquirer, or successor or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets, for the sole purpose of continuing the operation of the Services, and only if the recipient of your information commits to a Privacy Policy that has terms substantially consistent with this Policy.

Accessing, correcting, updating, or requesting deletion of your information.
Access to your information for printing, downloading or other data portability purposes.
Objecting to processing of your information, asking us to restrict processing of your information, or requesting the portability of your information.
Opting out from receiving marketing communications that we send you at any time. You may "opt out" of receiving promotional communications from Ryzer Recruit through the preferences under your account information settings on your account with us or by contacting us at the email address shown at the end of this Policy. Please note that changing your information through your user account settings, or otherwise opting out of receipt of communications from Ryzer Recruit, will only change or delete the data for purposes of future activities on our Services and for managing future communications from Ryzer Recruit.
Withdrawing your consent at any time if we have collected and processed your information with your consent. Withdrawing your consent will not affect the lawfulness of any processing that we conducted prior to your withdrawal, nor will it affect processing of your information conducted in reliance on lawful processing grounds other than consent.
Complaining to a data protection authority about our collection and use of your information. For more information, please contact your local data protection authority. Contact details for data protection authorities in the European Union are available here.
Note that Ryzer Recruit is a controller of your information. Other Recruit users, such as Ryzer Coaches, may also act as controllers of your information. You should contact these users directly if you have any questions about how they use information (e.g. your results from athletic testing at their event) collected on you.
Ryzer Recruit will not discriminate against you in any way if you make any changes to your sharing settings or make any requests to us regarding your Personal Data.
Some of the functionality of the Services is provided by third parties including the Ryzer Data Sources. These entities may collect or receive certain information about your use of the Services, including through the use of cookies, Web beacons, and similar technologies. Ryzer Recruit is not responsible for the privacy practices of these entities.
We employ technical and organizational measures designed to appropriately protect your information that is under our control and that we process on your behalf from unauthorized access collection, use, disclosure, copying, modification or disposal, both during transmission and once we receive it. We store all information that you provide to us on secure servers. We train employees and our affiliates regarding our data privacy policies and procedures, and permit authorized employees to access information on a need to know basis, as required for their role. We use firewalls designed to protect against intruders and test for network vulnerabilities. However, no method of transmission over the internet or method of electronic storage is completely secure.
Where you have a password, which enables you to use portions of our services, you are responsible for keeping this password complex, secure, and confidential. If you would like to update or change your password, you may select the "Reset Password" link on the login page. You will be sent an email with instructions to log in and change your password.
We retain certain information that we collect from you while you are a user of our Services, for a limited period of time as long as we need it to fulfill the purposes for which it was initially collected, and in certain cases where you have deleted your account, for the following reasons:

So ensure that we do not communicate with you if you have asked us not to;
To provide you with a refund, if entitled;
To better understand the usage patterns of our Services so that we can provide all users with the best possible experience;

Ryzer Recruit complies with the EU-U.S. Privacy Shield Framework and the Swiss - U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal information transferred from the European Union and Switzerland to the United States respectively. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. In compliance with the Privacy Shield Principles, Ryzer Recruit commits to resolve complaints about our collection or use of your personal information. EU individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Ryzer Recruit Data Protection Officer at privacy@ryzer.com.
The Services are neither intended for nor directed at children younger than 13 years of age. We do not knowingly collect or store personal information about children under the age of 13. Please do not submit your Personal Data through our Services if you are under the age of thirteen (13).
We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Policy by instructing their children never to provide Personal Data through our Services without their permission. If you believe a child under the age of thirteen (13) has provided Personal Data to us through our Services, please contact us at privacy@ryzer.com.
Ryzer Recruit is based in the United States. Information about you will be transferred to, and processed in, the United States and potentially countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country and, in some cases, may not be as protective. We have taken appropriate safeguards to require that your information will remain protected in accordance with this Policy.
If you access the Services from outside the United States, please be aware that information you provide to us or that we obtain as a result of your use of the Services may be processed and transferred to the United States and be subject to U.S. law. The privacy and data protection laws in the United States may not be equivalent to such laws in your country of residence. By using our website, participating in any of the Services, or by providing us with your information, you consent to the collection, transfer, storage, and processing of information to and in the United States and in accordance with U.S. law.
We wish to maintain accurate personal information. If you have submitted personal information through the Services, then you can (i) access and update your personal information by logging into your online account and making the appropriate changes here https://ryzer.com/ManageAccount/; or (ii) delete your account by emailing us at privacy@ryzer.com. Please note that if you delete your account, we may continue to retain your information on our servers for archival purposes.
If you have forgotten your login credentials, you can retrieve those via the automated password retrieval system.
Ryzer Recruit—as well as the Ryzer Data Sources that provide content and other functionality on the Services—may use a variety of technologies to learn more about how people use the Services and the Internet. This section provides more information about some of those technologies and how they work.
Cookies. Cookies are small text files that websites and other online services use to store information about users on the users’ own computers. For example, cookies can be used to store your sign-in credentials so that you do not have to enter them each time you return to a website. Cookies also may be used to store a unique identification number tied to your computer so that a website can recognize you as the same user across different visits to the website. You can configure your Internet browser to warn you each time a cookie is being sent or to refuse cookies completely.
Ryzer Recruit and the Ryzer Data Sources that provide content or functionality on the Services may use cookies to:
Collect information about your browsing activities in order to provide you with more relevant content and ads off the Services; and
Relate the information automatically collected when you use the Services to information we obtain from you directly or from commercially available sources.
Other local storage. We, along with third-party partners, may use other kinds of local storage, such as Local Shared Objects (also referred to as "Flash cookies") and HTML5 local storage, in connection with the Services. These technologies are similar to the cookies discussed above in that they are stored on your computer and can be used to store certain information about your activities and preferences. These objects are stored in different parts of your computer from ordinary browser cookies, however. Many Internet browsers allow you to disable HTML5 local storage or delete information contained in HTML5 local storage using browser controls.
Web beacons. We, along with our third-party partners, may also use technologies called Web beacons that communicate information from your Internet browser to a web server. Web beacons can be embedded in web pages, videos, or emails, and can allow a web server to read certain types of information from your browser, check whether you have viewed a particular web page or email message, and determine, among other things, the time and date on which you viewed the Web beacon, the IP address of your computer, and the URL of the web page from which the Web beacon was viewed. We and our partners use Web beacons for a variety of purposes, including analyzing the use of the Services and in conjunction with cookies to provide content and ads that are more relevant to you.
California residents are entitled twice a year, free of charge, to request and obtain certain information regarding our disclosure of certain categories of personal information to third parties in the preceding calendar year. In addition, California residents who are registered users of the Services and are under the age of 18 are entitled, in accordance with California law, to request and obtain removal of content and information that they themselves post as user content on the Services. You may request such removal by emailing us at privacy@ryzer.com. Please note that your request does not ensure the complete or comprehensive removal of the material.
Some web browsers may transmit "do-not-track" signals to the websites with which the user communicates. We do not currently take action in response to those signals. If an industry standard on responding to such signals is established and accepted, we may reassess how to respond to those signals.
Our Services may contain links or references to third-party owned and/or operated websites or content that we believe might be of interest to users, including websites of our partners, sponsors, advertisers, and affiliates. We do not control the content of these third-party websites. These third-party websites may send you their own cookies, collect data, or solicit personal information. Once you have clicked on a link to a third-party website and leave our Services, you must read the privacy policy of the third-party website to see how your personal information will be handled.
This Policy does not apply to information that you provide to third parties including the Ryzer Data Sources, such as other account holders or partners, and others with whom you may share information. Our Services may direct you to a third-party service, such as social media services, or a portion of our Services may be controlled by a third party (typically through the use of a frame or pop-up window separate from other content on our Services). Disclosure of information to these third parties is subject to the relevant third party’s privacy policy. We are not responsible for the third-party privacy policy or content, even if we link to those services from our Services or if we share information with these third parties.
Ryzer Recruit is a data controller. Ryzer Coaches are directly responsible for complying with all requirements of applicable EU privacy laws in connection with the information that they obtain and process on individuals such as Ryzer Members.
From time to time, we may revise this Privacy Policy to reflect changes to the scope of the Services or for other reasons. When we do, we will provide notice to you by publishing the most current version and revising the date at the top of this page. Therefore, it is important to check the effective date of the Policy posted here each time you use the Services. If we make any material change to this policy, we will provide additional notice to you, such as by sending you an email or displaying a prominent notice on our Services. By continuing to use the Services after we make changes, you indicate your consent to those changes.
